Terms of Engagement

1. Our role

Buyvest Pty Ltd (ACN 684 841 496) ('Buyvest', 'we', 'us' or 'our') is an Authorised Credit Representative (Credit Representative Number 567392) of Connective Credit Services Pty Ltd (Australian Credit Licence 389328), authorised under the National Consumer Credit Protection Act 2009 (Cth).

We operate as a mortgage broker providing credit assistance to clients in obtaining finance solutions from a panel of approved lenders.

This document outlines the terms upon which we agree to provide services to you. By engaging our services, you agree to be bound by these terms.

2. Scope of services

We will provide the following services to you:

• Assessment of your financial needs and objectives.
• Collection and analysis of your financial information.
• Assistance in identifying suitable credit products from our panel of lenders.
• Preparation and lodgement of finance applications.
• Ongoing support throughout the finance process.

We do not provide legal, tax, or accounting advice.

3. Your obligations

You agree to:

• Provide accurate, complete, and timely information.
• Inform us of any material changes to your financial circumstances.
• Ensure any co-applicants or guarantors are aware of and consent to this engagement.
• Review all loan documentation and seek independent advice where necessary.

You are responsible for ensuring the suitability of any product or loan that you accept.

4. Fees and commissions

We do not charge you a direct fee for our services in most cases. Instead, we may receive commission from the lender upon successful settlement of a loan. These commissions vary between lenders and will be disclosed to you in your Credit Proposal Disclosure Document (CPDD).

In some complex cases (e.g., SMSF lending, commercial finance, asset finance), we may charge a professional fee, which will be disclosed to you in writing before proceeding.

5. Third parties

In providing services, we may refer you to trusted third-party professionals such as solicitors, conveyancers, financial planners, or insurance providers. We may also receive or pay referral fees in accordance with applicable laws. These relationships will be disclosed where applicable.

You acknowledge we are not liable for the conduct, advice, or performance of any third-party provider.

6. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any loss or damage arising from inaccurate information provided by you.
• We are not responsible for any lender's decision to decline, delay, or alter the terms of a loan.
• We are not liable for indirect, consequential, or financial losses, including lost opportunities.

Our total liability (if any) is limited to the amount of commission we receive for the transaction.

7. Privacy

We collect, use, and disclose your personal information in accordance with our Privacy Policy, which is available at buyvest.com.au/privacy-policy or on request. By engaging us, you consent to the collection and use of your information for the purpose of obtaining finance on your behalf.

You may request access to, or correction of, your personal information at any time.

8. Intellectual property

All materials, reports, tools, and strategies provided to you by Buyvest remain our intellectual property and may not be reproduced, shared, or used for commercial purposes without our prior written consent.

9. Termination

You may terminate this engagement at any time by providing written notice. We reserve the right to terminate our services if:

• You provide false or misleading information.
• You fail to cooperate or communicate within reasonable timeframes.
• You breach these terms.

In such cases, we are not liable for any resulting loss or delay.

10. Dispute resolution

We are committed to resolving any concerns quickly and fairly. If you have a complaint, please contact us directly using the details in Section 12 below.

If your complaint remains unresolved, you may lodge a complaint with the Australian Financial Complaints Authority (AFCA):

11. Governing law

These terms are governed by the laws of New South Wales and the parties submit to the jurisdiction of the courts of that state.

12. Acknowledgement and acceptance

By instructing us to proceed, you confirm that:

• You have read and understood these Terms of Engagement.
• You consent to us acting on your behalf to obtain finance solutions.
• You agree to the terms set out above.
